Robert L. "Bob" Smith II has been acquitted from charges he stole thousands of dollars and
products from Wendy's in Spencer. A Roane County jury declared Smith was a partner in the
business with Ripley resident Dr. Randy Smith, which cleared the way for Judge David Nibert to
enter an order for acquittal on the felony charges.
The case begin in 1998-99, when his partner (no relation) Dr. Randy Smith, a dentist, filed the
charges. Both Smiths had been long-time friends.
Bob Smith says he now wants his ownership of the business restored, since Wendy's
restaurants have been sold. Owner Dr. Randy Smith told his former partner he can have half
the loss, since the businesses were not making money.
