STUMPTOWN NEWS FROM 1908 - 'Evidence Rather Flimsy' |

Transcribed by Norma Knotts Shaffer from microfilm of the Calhoun Chronicle dated 6/16/1908 and 6/30/1908 - Last Tuesday L.W. Linger went before Squire M.J. Stump and complained on oath that Robert and Okey Philips did on the 29th day of last April, set a savage dog on a cow belonging to the said Linger, and ran her through the barbed wire fence. A warrant was issued and placed in hands of constable Kindell to execute, made returnable on the 10th day of June. The warrant was returned executed by James Kindell and Ofa Stump. The case was called. Lewis Poling appeared for the State, and W.B. Philips, father of the two boys, appeared for the defence, and asked for a continuance after hearing an address from Poling on the subject. W.B. Philips took the floor and delivered such an address that Poling did not reply, and the case was continued until June 13th, 1908, at 8 o'clock a.m. - Scott Peningar was looking after business on Steer Creek last week. There is strong talk of Peninger being a candidate. He is a good man and will get some votes. - The Assessor has been up in this part of the country for the last few days. - The case of the State against Robt. and Okey Phillips which has been pending before Squire Stump for some time was called last Friday. Lewis Poling represented the State and Aristotle Smith and J.T. Waldo the defense. A jury was summoned and the case was tried. The evidence was rather flimsy and a verdict of not guilty was returned. |
