DUPONT WILL APPEAL JUDGE'S RULING - "C-8 Has No Known Health Effects"

DuPont plans to appeal a Wood County Circuit judge's ruling that found C-8, a chemical used to make Teflon and other products, is toxic and hazardous to humans.

DuPont's lawyer, Larry Janssen, says Judge George Hill's April 29th ruling was based on unsubstantiated claims by the plaintiffs.

DuPont scientists and officials have said there are no known health effects from the chemical, which the company has used for more than 50 years.

Industry studies have linked C-8 to a variety of health problems, including cancer and liver damage, in rats. But regulators don't know whether those findings are relevant to humans.

Lubeck and Washington area residents sued DuPont in August 2001. They alleged the company's Washington Works plant had released the chemical and contaminated water supplies.

Hill's ruling allows a class-action lawsuit to proceed.

DuPont says the C-8 issue should be resolved in a jury trial, in which scientific evidence can be presented.

The company has until May 30th to file the appeal.
