CALHOUN GRAND JURY RENDERS INDICTMENTS MONDAY

The Grand Jury of Calhoun County met Monday in Calhoun County with Judge Anita Harold Ashley presiding. After hearing cases presented by Prosecutor Shannon S. Johnson after due deliberation, the Grand Jury returned the following indictments:

Laszlo Nemeth, 59 and Leila Hardway 48, were indicted on one count of Possession with Intent to Deliver and Delivery of a Controlled Substance, a Felony; one count of Conspiracy, a felony; and one count of Possession by Prohibited Person of a Firearm, a Felony. This case was investigated by Trooper J. M. Mack of the West Virginia State Police.

Larry Harold, 51, was indicted on one count of Breaking and Entering, a Felony; one count of Breaking and Entering of Motor Car, a Misdemeanor; one count of Petit Larceny, a Misdemeanor; and one count of Trespass, a Misdemeanor. This case was investigated by TFC D. C. Moore of the West Virginia State Police.

Robert W. Hupp, 41, was indicted on one count of Possession with Intent to Deliver and Delivery of a Controlled Substance, a Felony. This case was investigated by Sheriff Jeffrey S. Starcher of the Calhoun Sheriff’s Department.

Dennis D. Keener, 57, was indicted on one count of Driving Under the Influence, third or subsequent offense, a Felony; and one count of Driving Revoked for DUI, Third Offense, a Felony. This case was investigated by Sgt. C. J. Weekley of the West Virginia State Police.

Phillip N. Keener, 38, was indicted on two counts of Attempted Murder, both Felonies; two counts of Wanton Endangerment Involving a Firearm, both Felonies; and two counts of Child Neglect Creating Risk of Injury, both Felonies. This case was investigated by Cpl. J. B. Hunt of the West Virginia State Police.

Jeffrey Ernest Mollahan, 45, was indicted on one count of Breaking and Entering, a Felony; and one count of Grand Larceny, a Felony. This case was investigated by Cpl. J. B. Hunt of the West Virginia State Police.

Gary Lee Nicholson, 53, was indicted on two counts of Possession with Intent to Deliver and Delivery of a Controlled Substance, both Felonies. This case was investigated by Cpl. B. E. Young of the West Virginia State Police.

Gary Lee Nicholson, 53, was indicted on one count of Attempt to Escape from Custody a Felony, a Felony; one count of False Statement to an Officer, a Misdemeanor; and one count of Obstructing an Officer, a Misdemeanor. This case was investigated by Sheriff Jeffrey S. Starcher of the Calhoun Sheriff’s Department.

Gary Lee Nicholson, 53, Brian Hardman, 48, April Ball, 38, Carrie Ball, 48, was indicted on two counts of Possession with Intent to Deliver and Delivery of a Controlled Substance, both Felonies; two counts of Conspiracy, both Felonies. Also in the same case, Brian Hardman was indicted on one count of Child Neglect Creating Risk of Serious Bodily Injury, a Felony; and Gary Lee Nicholson was indicted on ten counts of Possession by Prohibited Person of a Firearm, all Felonies. This case was investigated by Cpl. B. E. Young of the West Virginia State Police.

Shirley Carroll Rush, 40, was indicted on one count of Attempt to Commit a Felony, punishable less than life, a Felony. This case was investigated by Cpl. J. B. Hunt of the West Virginia State Police.

Brian Lee Smith, 33, was indicted on two counts of Attempted Murder, both felonies; and one count of Brandishing a Deadly Weapon, a Misdemeanor. This case was investigated by First Sgt. J. C. Saurino of the West Virginia State Police.

Joseph Southers, 43, and Chasity Bell, 35, were indicted on one count of Fraudulent Schemes, a Felony; two counts of Uttering, both Felonies; one count of Financial Exploitation of an Elderly Person, a Felony; one count of Possession of Counterfeit Bank Notes with Intent to Utter, a Misdemeanor; and four counts of Conspiracy, all Felonies.

Joseph Southers, 43, was also indicted on two counts of Forgery, both Felonies; and two counts of Uttering, both Felonies. This case was investigated by Cpl. B. E. Young of the West Virginia State Police.

Roxie Troup, 29, and Kim Duskey, 48, were indicted on one count of Possession with Intent to Deliver and Delivery of a Controlled Substance, a Felony; and one count of Conspiracy, a Felony. This case was investigated by Officer Charles Stephens of the Grantsville Police Department.

Dylan Wagoner, 23, was indicted on two counts of Possession with Intent to Deliver and Delivery of a Controlled Substance, both Felonies. This case was investigated by Deputy Jason Chang of the Calhoun County Sheriff’s Office.

Indictments returned against individuals are merely charges at this time and are not indications of guilt. All the above Defendants are presumed innocent until proven guilty.
