FORMER MAGISTRATE'S SENTENCING TODAY - Johnson Could Face 1-10 Year Sentence, $2500 Fine

A sentencing hearing for former Calhoun Magistrate Steve Johnson is scheduled Monday morning before Judge David Nibert, according to Calhoun Circuit Clerk Shelia Garretson.

Johnson pled guilty in August to stealing from his office, entering into a plea bargain arrangement with the court. The plea, which allowed Johnson to say he stole $1000, crossed the felony threshold, although Prosecutor Robert William Schulenberg II said "He misappropriated more than $1000," in what he described as a violation of public trust.

Judge Nibert ordered Adult Probation Officer Patsy McCartney of Grantsville to do a pre-sentence investigation, which will be used in Johnson's sentencing today.

Johnson could face a maximum sentence of 1-10 years in prison and a $2500 fine.
