BRAXTON PROSECUTOR RESIGNS AFTER CONFLICT

(03/17/2016)
The Braxton county prosecutor has resigned.

Court documents show Kelly McLaughlin didn't recuse herself from a case where a family member was accused of sexually abusing an 11-year-old child.

The case happened back in July 2013.

Court documents and testimony explain McLaughlin didn't request a special prosecutor and never recused herself from the case.

According to a stipulation agreement, McLaughlin will not run for prosecutor again and she will not be a lawyer for the next three years.

McLaughlin has also lost her law license.

The Supreme Court will have a final say on the matter in a few weeks.

The Braxton County Commission has temporarily appointed the assistant prosecutor to the position for the next 30 days.
