LAWSUIT FILED AGAINST WIRT SCHOOLS OVER STUDENT INJURY RESULTING IN EYESIGHT LOSS

A Wood County mother has filed a lawsuit against the Wirt County Board of Education, saying her son was seriously injured in a classroom incident.

Amy Lyons says in December 2012 her then 9-year-old son was participating in a science project at the Wirt County Primary Center, when a shard of plastic landed in his eye, according to the suit.

A complaint says the teacher, Rebecca Smith, didn't offer eye protection to any of the students during the exercise.

Lyons says her son has had two eye surgeries and is permanently blind in his left eye.

Judge Waters Thursday granted a motion to dismiss punitive damages.
