CALHOUN CIRCUIT COURT HEARS NUMEROUS FELONY CASES

Judge David Nibert presided over Calhoun Circuit Court Tuesday.

Prosecutor Shannon Johnson said Sherry Lynne Jones entered a guilty plea to False Statements in Obtaining Welfare Benefits, a misdemeanor.

Jones waived the right to a pre-sentence investigation and was sentenced to one year supervised probation and was ordered to make restitution in the amount of $1,127.42 to the West Virginia DHHR for fraudulent medical benefits that she had received. She was also ordered to pay court costs and attorneys fees.

Adam Parsons appeared on a Motion for Bond Reduction on his felony charges of malicious assault related to an incident on Crummie Creek. His motion was withdrawn by his attorney as he had already posted bond with the clerk.

Eric Ray Jones appeared before the Court on a hearing to discuss his return from the Anthony Center Program for Youthful Offenders. The Anthony Center deemed that he was unfit to complete the program. Jones did not contest his return and his case will appear for a further sentencing on March 16th.

Joshua Slider was scheduled to appear before the Court for a Plea Hearing. He did not appear, and his case was continued to March 16th for entry of a plea.

David Bailey appeared on the State's Motion to Revoke his Parole. He admitted that he had violated parole and was sentenced to forty eight hours in the regional jail.

Charles Norman entered a plea of guilty to Conspiracy to Operate a Clandestine Methamphetamine Drug Laboratory, a felony, and a plea of no contest to Delivery of a Controlled Substance, a felony.

Pending the pre-sentence investigation, the court sentenced Norman to one to five years in the state penitentiary for Conspiracy and one to five years in the state penitentiary for Possession with Intent to Deliver and Delivery of a Controlled Substance. The case will come on for further sentencing on May 19th.

On March 3rd, Judge Nibert, in cases against Allen Nelson, February Williams, Josh Whipkey and Jeremy Saunders were all continued.

Nelson's case was continued by the defense to allow more time to prepare for trial.

Williams' case was continued by Prosecutor Shannon Johnson, having received multiple boxes of discovery late in the case.

Whipkey's case was continued by the prosecutor because two essential witnesses for the state were unavailable.

The case against Saunders was continued by the defense because the judge granted his motion for an expert witness to assist in his defense and interpretation of the DNA results.

Leon Kerby entered a plea of guilty to Child Abuse Resulting in Injury, a misdemeanor. He is set for sentencing May 12th. Christopher Lamp entered a plea of guilty to unlawful assault, a felony. He is also set for sentencing on May 12th.

The next court date is March 16, with Judge David Nibert presiding.
