Trooper accused of misleading grand jury in sexual abuse case

Charges against a suspended Ritchie County High School teacher who was accused of sexually abusing two students were dropped after the defense said a West Virginia State Police trooper made misleading statements to a grand jury, court documents show.

Two male students had accused David Peter Weekley, 43, of Pennsboro, of sexually abusing them on school grounds. One student said he was abused twice last school year, while one student said he was abused in May of 2013.

In a hearing on Nov. 25, Weekley and his lawyer, Judith McCullough, say that State Police Cpl. Jason Brewer, lead investigator on the case, repeatedly told the grand jurors that the statements of one of the alleged victims never changed through multiple interviews.

Brewer told the grand jury that the victim's story "did not change one bit. He was right on the money with everything. Nothing changed," according to the motion.

"The truth is that material facts in [the victim's] story changed every time he told it, and Cpl. Brewer was either present when these changes occurred, or he was in possession of that information at the time he testified to the Grand Jury," the motion says.
