SUTTON COMPANY FINED FOR WV WATER SPILL

(12/23/2014)
A Sutton-based company working in Preston County is facing some small fines from the state Department of Environmental Protection under the Water Pollution Control Act.

According to a Notice of Violation from WVDEP, Breakaway Inc. discharged toxic sediment into Deckers Creek near Bretz, causing "conditions not allowed in waters of the state."

Breakaway is performing Abandoned Mine Lands (AML) reclamation work at a former mining site near Miller Mine Road for WVDEP.

Hundred of mining operations have been abandoned during the past several decades, with clean-up costs estimated over one billion dollars.

Most of those companies went out of business.

Breakaway has agreed to pay administrative penalties.

The company will be assessed a penalty of $8,830. Of that, $3,000 will be paid in $1,000 increments due in January, February and March. If further violations are noted, the company will have to pay the remaining $5,830 of the penalty.
