12/08/2015 - Paul Randolph Hammer (Crabtree), about 25, of Munday, Wirt County was sentenced Tuesday in Wirt Circuit Court related to sexual assault and incest.

Hammer is the third member of his family to be sentenced on related charges.

Hammer had been indicted of sexually assaulting a female at least twice between January 2008 and December 2009 at their former residence on Brohard Road, according to the criminal complaint.

On count one, sexual assault first degree, he was sentenced to prison not less than 15 years nor more than 35, with 596 days served.

On count two, sexual assault second degree, he was sentenced to prison for not less than 10 years nor more than 25, with 596 days served.

Counts one and two to run consecutively.

On count four, incest, he was sentenced to prison to not less than 5 years or more than 15, with zero days served, to run consecutively with counts one and two.

UPDATE 10/21/15 - Randy "Red" Hammer (Crabtree), about 62, of Munday, Wirt County, was found guilty of six counts of sexual abuse in August during a three day trial, relating to incest, sexual abuse and sexual assault.

He has now been sentenced by the Wirt Circuit Court to the WV Division of Corrections.

Count One: Not less than 15 years nor more than 35 years, with credit of 571 days for time served.

Count Two: Not less 10 years nor more than 20 years.

Count Three: Not less than 5 years nor more than 15 years.

Count Four: Not less than 10 years nor more than 25 years.

Count Five: Not less than 10 years nor more than 20 years.

Count Six: Not less than 5 years nor more than 15 years.

Sentences to run consecutively.

(Crabtree) Hammer was ordered to register as a sex offender and will be placed under 50 years of supervised release.

Paul (Crabtree) Hammer will be sentenced on December 8.

UPDATE 9/17/15 - Paul Randolph Hammer (Crabtree), about 25, was found guilty during court proceedings Thursday in Elizabeth.

Hammer had been indicted of sexually assaulting a girl at least twice between January 2008 and December 2009 at their former residence on Brohard Road, according to the criminal complaint.

He was indicted for incest, sexual assault 1st, 2nd and 3rd degree.

He will be sentenced on December 8.

The sentencing of his father, Randy "Red" Hammer (Crabtree), is set for October 13.

UPDATE 8/20/15 - A Wirt County jury Wednesday found Randy (Crabtree) Hammer guilty in all six counts related to the sexual abuse of a female family member.

Wednesday was the third day of his trial.

Hammer, about 62, of Munday, was charged with six different counts relating to incest, sexual abuse and sexual assault.

Hammer's two sons are also involved in the abuse case.

Thomas Hammer, about 23, already went to trial and has been sentenced to 15 years in prison for sexual assault and incest.

Hammer's other son, Paul Hammer, is set for trial on September 14, 2015.

UPDATE 6/5/15 - A Wirt County man was found guilty of multiple counts of sexual abuse in court this week in Elizabeth.

Thomas Rex Hammer (Crabtree), about 23, was found guilty on sexual assault 2nd degree, sexual assault 3rd degree and incest. He is set for sentencing on August 11.

A trial is being scheduled for Paul Randolph Hammer (Crabtree).

A trial has been set in Wirt County for June 1 for Paul Randolph Hammer (Crabtree), 25, his brother, Thomas Rex Hammer (Crabtree), 23, related to multiple charges of sexual abuse of a female family member.

A trial is set for August 17 for Randy Lane Hammer (Crabtree), 61, related to similar charges.

All are residents of Munday WV.

The cases are being considered for plea bargain agreements, according to a statement issued earlier by Prosecutor Theodore "Ted" Davitan's office.

The three were indicted by a Wirt grand jury on June 30, 2014.

The elder Hammer (Crabtree), according to the Wirt County Circuit Clerk, was indicted on six counts, two counts of incest, two counts of sexual abuse by a parent, sexual assault first degree and sexual assault 2nd degree.

(ORIGINAL STORY 4/22/14) Three members of a Munday, Wirt County, family are in North Central Regional Jail, charged with multiple counts of sexual abuse on one or more family members.

State Police and Wirt County authorities, reportedly 20-30 officers described as a "task force," went to the remote residence of Randy Lane (Crabtree) Hammer and arrested him and two of his sons about 7 a.m. Tuesday.

Crabtree more recently adopted the last name Hammer, and apparently had his three sons and three daughters use the Hammer name. His wife, Sandy, had also adopted the name.

The family, who moved to the area from Florida about 13 years ago, lived on a wooded hillside in campers and a trailer about two miles from the former Village of Munday.

One of the three girls in the family was reported missing a few weeks ago, and family or friends issued a media request to the Hur Herald, describing her and asking for assistance in getting her home.

Neighbors told the Herald that the children were well-behaved and people in the Munday community had reached out to them for years, giving assistance and sometimes giving them jobs.

A neighbor, who said he will be going on record, told the Herald, "The system really failed these children, authorities being called many times."

The source said, "As far as I know, none of the children spent a day in public school. They didn't seem to have Social Security numbers or birth certificates. They always addressed their father as Sir."

"The people of this community have really tried hard to help the children, who deserve mercy. I hope the police come and talk with us," a neighbor who had worked with the children concluded.

Neighbors said that Randy Crabtree was reportedly a member of the Freemen Society, a group that believes that statute law is a contract, and that individuals can opt out of statute law, choosing instead to live under what the group calls "common" (case) and "natural" laws.

In 2006, the Hur Herald reported that Randy Crabtree filed a case against a Calhoun County deputy sheriff, after being charged, apparently more than once, for not having a drivers or car license, driving suspended, no insurance, no registration or inspection sticker.

Crabtree took his case to the Supreme Court, which ruled against him, and he was eventually sentenced to about one year in jail for numerous violations.

The Lee County Sheriff's Department in Ft. Myers FL says Crabtree was charged in 1994 and 1999, related to no tags, no drivers license and a failure to pay fines.
