HUSK MURDER TRIAL SET FOR DECEMBER - Circuit Court Issues Decisions Thursday

Following a pre-trial hearing Thursday in Calhoun Circuit Court before Judge David W. Nibert, the Husk murder trial is set for December 3.

Husk is charged with the 2011 murder of John Dale Cyrus. According to the criminal complaint, the shooting happened as a bitter dispute between the two men over family issues.

In July, for a second time their was a mistrial, with efforts to seat a jury failing because the pool of potential jurors told the court they had preconceived beliefs regarding the case, had acquaintances or relationships with either Husk or the victim Cyrus, or other connections or reasons that could influence their impartial decision.

Prosecutor Shannon Johnson said following the last mistrial, "We will make one more attempt to seat a jury in Calhoun. We're hopeful that a jury can be seated."

Richard Wayne, 45, appeared with counsel John Oshoway for a plea hearing. The state filed an Information against Mr. Wayne for one count of Possession with Intent to Deliver a Controlled Substance (marijuana), a felony.

Mr. Wayne entered a plea of guilty to the Information and the Judge Nibert referred the case to the Probation Officer for a pre-sentence investigation.

As part of the plea, Wayne agreed to relinquish to the Town of Grantsville $956.00 in drug monies seized from the defendant. The state agreed to recommend an alternative sentence, according to Prosecutor Shannon Johnson.

Nancy Hillegas, 29, appeared along with counsel Justin White for a plea hearing. Hillegas entered a guilty plea to Petit Larceny, a misdemeanor.

Hillegas agreed to make restitution to the victim and the State will recommend alternative sentencing. The Judge referred the case to the Probation Officer for the completion of a pre-sentence Investigation.

Jerry Glenn McKown, Jr., 26, appeared along with counsel Ryan Ruth for a plea hearing. McKown entered a plea of guilty to one count of Operating a Clandestine Methamphetamine Laboratory, a felony.

Prosecutor Johnson said the State will withhold any recommendation of sentence until review of the pre-sentence investigation which will be completed by the Probation Officer.

The rest of the felony cases were continued to November for further hearing.
