HUSK-CYRUS MURDER CASE SET FOR APRIL 23 - Jury Will View Scene Of Shooting, Goodrich Admits Probation Violation

Thomas Lee Husk appeared in Calhoun Circuit Court before Judge David W. Nibert for a pre-trial hearing in the shooting death of John Dale Cyrus in June, 2011.

Defense counsel John Oshoway filed a motion to dismiss based on testimony of a Grand Jury witness. Judge Nibert deferred ruling on the motion.

Prosecutor Shannon Johnson made a motion for a jury view of the scene where the shooting happened, which was granted.

A pre-trial hearing has been set for April 13.

The trial has been set for April 23.

Paul Richard Goodrich III, 25, of Grantsville, who had faced multiple charges related to the manufacture of meth in 2012, admitted in court to violating his probation.

Prosecutor Shannon Jones asked the court to impose a sentence of one to three years in the state penitentiary.

The defendant asked for home confinement. The court imposed the sentence of 1-3 years, but granted the defendant's motion for alternative sentencing and ordered that Goodrich be placed on home confinement with electronic monitoring.

The court said that Goodrich will be accepted to a long term residential rehab program within 60 days of his release.

Matthew Nicholas admitted to court that he violated his probation. The state asked the court to impose the original sentence, after which Nicholas asked for home confinement.

Judge Nibert ordered that the Nicholas be remanded to the custody of the Department of Corrections to serve the remainder of his sentence, but did however grant the defendant's motion for home confinement with electronic monitoring based upon approval from the Ritchie County Sheriff's Department.

In a case related to meth making, Jerry Glen McKown's trial was set for July 23. A pre-trial hearing is set for June 28.
