COURT RULES IN FAVOR OF STATE POLICE OVER VIOLATION SELLING TOBACCO TO MINORS

A Kanawha County jury has ruled in favor of state trooper Jared Brewer from the Logan detachment in a wrongful arrest suit brought against him by a store owner.

Patricia Trogdon v. West Virginia State Trooper Jared Brewer went through a three-day trial before Judge Carrie Webster, over an incident that happened three years ago over the woman's sale of tobacco to a minor.

Trogdon sued Brewer for malicious prosecution and abusive process following a July 2008 arrest for obstruction of an officer, Trogdon refused to accept service of a citation for the sale of the tobacco.

The citation for Trogdon had been dismissed for failure to prosecute by the Logan County Prosecutor.

"I am pleased to inform the citizens of West Virginia that through this court finding, justice was served in this particular case," said the WV State Police in a press release.
