ROANE COUNTY COUPLE SUE OVER INJURIES

WINFIELD - A Newton couple is suing Modular Building Consultants of West Virginia, Inc., after they claim the company was responsible for a car accident near Left Hand, W.Va.

Billy Joe McLaughlin was also named as a defendant in the suit.

On July 14, Jarrett L. Smith was traveling on W.Va. Route 36 approaching the area of Geary Elementary School, according to a complaint filed Sept. 28 in Putnam Circuit Court.

Smith claims at that time, he struck a tractor trailer truck owned and driven by the defendants that was in his driving lane.

At the time of the collision, the defendants were blocking Smith's lane of traffic and caused him to collide with the tractor trailer, according to the suit.

Smith claims he sustained injuries when he collided with the tractor trailer.

The tractor trailer was parked on a highway where the safety and convenience of the traveling public was endangered, which is in violation of West Virginia Code, according to the suit.

Smith and his wife, Sharon Smith, are seeking compensatory damages. They are being represented by Michael O. Callaghan.

The case has been assigned to Circuit Judge O.C. Spaulding.
