WV KNIFE AND GUN CLUB - Man Arrest With Gun On School Grounds

(08/22/2011)
MAN ARRESTED FOR GUN ON SCHOOL GROUNDS - William H. "Billy" Samples Jr., 34, of St. Albans, was arrested at Hayes Middle School where football practice was taking place, violating WV law regarding guns on school property.

Officers found a .40-caliber handgun on Samples, the magazine loaded with 13 rounds. Saint Albans police went to the school after a 911 call regarding a dispute, a man saying his car was keyed by Samples.

The complainant said Samples walked away, saying the suspect lifted his shirt and a handgun could be seen in his rear waistband.

Samples walked behind the school to the football field where the practice was taking place.

Saint Albans Police Patrolmen D. F. Wyatt and P. A. Bass spotted Samples standing near the field where several kids were practicing football. Parents and coaches were present at the time.

Officers seized the weapon and arrested Samples.

According to state law, it is against the law to carry a firearm on "any public or private primary or secondary education building, structure, facility or grounds thereof" (WV Code 61-7-11A).

It is a felony punishable by two to 10 years in prison. Samples has a valid carry permit.

In some USA states, gun rights activists have had legislation passed that allows guns on school property.

Former SC Gov. Mark Sanford signed a gun bill into law that anyone with a concealed weapons permit can have a car filled with loaded shotguns, rifles, or handguns on school property in that state.
