"POSITIVE" FORENSIC EVIDENCE IN DENMARK CASE - Smithsonian Examines Content Of Grave

There is a turn in the William Seth Denmark case.

Calhoun prosecutor Rocky Holmes said there is new forensic evidence in the case.

Denmark, 23, is currently facing criminal charges related to kidnapping, which is centered on the alleged murder and burial of David Beach on the Denmark farm near Arnoldsburg.

Denmark has been held in Central Regional Jail since early 2010.

"We have a positive forensic report from the Smithsonian Institution," said Holmes, indicating evidence sent to Washington from a grave apparently has indications of human remains.

Police did not find a body in the grave, although a female witness said she saw Denmark bury the dead youth. Authorities have indicated they believe the body was moved following the alleged murder and burial.

Criminal cases against members of the Denmark family appeared to be fading, apparently with a lack of evidence.

"When is something going to happen?," asked defense attorney Ernie Skaggs during a March hearing, speaking to Judge David Nibert.

Skaggs told the court the case against Denmark has been languishing too long, saying "Bond, home confinement, or something needs to happen since he has been appearing for a year, while the system hasn't taken action."

Judge Nibert expressed concern, "the case has been continued time and again," although he continued to deny bond, setting a new hearing on the matter for May 23 at 9:30 a.m.

Criminal charges against Denmark's parents have been dropped or reduced.

The criminal complaints against parents William Anthony Denmark, 58, and his wife Jackie Lynn Denmark, 56, were related to their involvement in the alleged criminal activities of their son.

During a hearing earlier this year, following testimony about the case, Judge Nibert ruled that all charges be dropped against William Anthony Denmark, without prejudice, meaning charges could be refiled.

Judge Nibert told Denmark, "The matter is dismissed, and you are free of any charges or obligations," with Denmark being released from home confinement.

The elder Denmark had been indicted for conspiracy to commit a felony, related to the shooting of Aaron Lloyd. He was initially charged with conspiracy to inflict bodily injury.

Jackie Lynn Denmark, mother of William Seth Denmark and wife of William Anthony Denmark, was released from Central Regional Jail on a $100,000 bond last June and placed on home confinement.

She had been charged with aiding and abetting kidnapping, allegedly committed by her son.

Jackie Denmark is no longer on home confinement.

The case unfolded in February, 2010, when Calhoun and Roane authorities went to the Denmark farm near Arnoldsburg with a search warrant looking for Beach's remains.

Beach has been missing since 2006.

William Seth Denmark was charged with kidnapping Roane County resident Veronica Cottrill and allegedly holding her at gunpoint while he buried Beach's body, according to a criminal complaint filed by lead investigator Cpl. Doug Starcher of the WV State Police.

Malicious assault and conspiracy charges against Seth Denmark have been dismissed, according to special prosecutor Josh Downey, who has now been relieved of the case.

Those charges were related to an earlier incident where Denmark and David Beach, the alleged murder victim, went to Jesses Run where Denmark allegedly shot Aaron Lloyd.

Downey said that set of charges were dismissed because of technical issues, but could be refiled.

Since Beach's body was not found, court records say that police obtained a second search warrant in March, 2010 for a vehicle owned or used by Seth Denmark, saying that an informant stated that Denmark admitted to moving Beach's body from a grave in which he was allegedly buried.

Police obtained the vehicle, with authorities likely doing forensics on the vehicle that would connect Denmark with the murder of Beach.
