RUSH JAILED FOR BATTERY ON DNR OFFICERS - Found Guilty For Obstructing

(05/02/2002)
Sand Ridge resident, James Paul Rush, about 19, has been sentenced in Magistrate Rick Postalwait's court to Central Regional Jail. He will serve six months for committing battery on DNR officers, who were investigating illegal deer kills.

Rush was also found guilty for obstructing an officer, and will serve an additional six months on home confinement. An assault charge was dropped, according to court records.

DNR officers John Apgar and Sammy Goins were transporting Rush to a residence during which time he made a threat, stating "If I had a shotgun I would use it on you, and you wouldn't have the balls to do anything about it," said Apgar.

A short time later the officers attempted to handcuff Rush, who resisted. Apgar said we told him he was not under arrest, the handcuffing was for our safety and his. After a scuffle, the officers used spray to restrain him. "Fortunately, no one was seriously injured," said Apgar. Officer Goins suffered minor cuts and abrasions.
