An Arnoldsburg man, Douglas W. Marks, 38, has entered a guilty plea to a charge that he helped his now deceased wife Heather Dawn Marks, 34, in attempting to defraud a pharmacy to obtain a controlled substance.

The charges say Ms. Marks pretended to represent a doctor's office when phoning-in a prescription to Fruth Pharmacy in Spencer, last July.

The Marks' attempted to obtain the prescription drug alprazolam. The drug is sold under the trade name Xanax.

Heather Dawn Marks, 34, was being charged with attempting to fraudulently obtain goods by false pretenses and conspiracy, both felony charges. They gave an Orma address at the time of their arrests.

Police said she impersonated a nurse from the Roane General Medical Clinic to request a prescription.

Heather Marks was found dead at a friend's house last November, from what authorities indicated was a drug overdose.

Douglas Marks will be sentenced on July 26 for his role in the incident.
