PLEA AGREEMENT IN CHRISTOPHER TODD SMITH DRUG CASE - Sentencing Set For June

A long awaited trial related to 2007 drug charges against Christopher Todd Smith has been canceled, following a plea agreement reached with officials.

The trial was set for Wednesday.

The plea agreement is over "a gallon bag" of marijuana with intent to deliver and was presented by Smith's attorney Tom Whitter to Judge David Nibert.

Other charges filed against Smith in the 2007 incident involved the alleged shooting of a pellet gun at a newspaper carrier. Those charges were dropped because of evidence problems.

Judge Nibert had rejected a request for a plea agreement in 2009.

Tuesday's agreement appears to have been one of two options, incarceration in prison for not less than one year nor more than three, or a determined number of days to be served in Central Regional Jail.

Scheduling problems surfaced over a sentencing date, because Smith is obtaining knee surgery.

The sentencing date is set for June 18 at 2 p.m.
