CHRISTOPHER TODD SMITH'S TRIAL RE-SCHEDULED FOR APRIL, 2010

(11/17/2009)
Christopher Todd Smith's long-delayed trial on drug charges scheduled for November has been re-scheduled for April, 2010.

The motion for a continuance was approved last week in Calhoun Circuit Court upon request of the defendant.

The continuance is reportedly based on the defendant's request for an expert to examine the evidence.

The drug charges were brought against Smith in 2007 by the Grantsville Police Department.

Last April, Judge Nibert rejected a plea agreement regarding Smith's charges, indicating Smith had a 20-year history of criminal charges in several counties.

Smith had pled guilty to "conspiracy to possess a controlled substance with intent to deliver with an unknown individual," after police said they discovered a gallon bag of marijuana in his residence in 2007.

During that same time, Smith was cleared of charges filed against him for allegedly shooting a BB gun at a Charleston Gazette newspaper carrier, indicating a problem with inconsistent testimony.
