CHRISTOPHER TODD SMITH TRIAL DELAYED AGAIN

(11/03/2009)
Christopher Todd Smith's long-delayed trial on drug charges scheduled for jury trial Wednesday has been canceled.

Judge David W. Nibert has rescheduled the trial for November 12.

Smith's attorney appeared before Judge Nibert today, issuing the request for a delay.

The basis for the request was not learned this evening.

The drug charges were brought against Smith in 2007 by the Grantsville Police Department.

Last April, Judge Nibert rejected a plea agreement regarding Smith's charges, indicating Smith had a 20-year history of criminal charges in several counties.

Smith had pled guilty to "conspiracy to possess a controlled substance with intent to deliver with an unknown individual," after police said they discovered a gallon bag of marijuana in his residence in 2007.

During that same incident, Smith was cleared of charges filed against him for allegedly shooting a BB gun at a Charleston Gazette newspaper carrier, indicating a problem with inconsistent testimony.
