UPDATE: CHRISTOPHER TODD SMITH TRIAL DELAYED - Vandal Sentenced To State Penitentiary

A trial scheduled this week over drug charges against Christopher Todd Smith was continued by Judge David W. Nibert, who first indicated he did not want to continue the case, saying the case has been on the court docket for five terms of court.

Smith's attorney Tom Whitter presented motions for a continuance, in addition to a number of motions from quashing the indictment to a protective order to a change of venue.

A pre-trail hearing for the motions has been set in Spencer on September 22 at 10 a.m., with a new trial to be scheduled at a later date.

Smith was charged in 2007 by Grantsville Police Chief Charles Stephens.

The court sentenced Jimmy Jack Vandal to one-to-ten years in the state penitentiary for property crimes committed in Calhoun and Wirt.

The court determined Kenneth Rush incompetent to stand trial, in relation to charges of sex offenses lodged against him, and he was sent to William Sharpe Hospital in Weston.

Randy Shrader of Creston has plead guilty to charges related to the manufacturing of marijuana, sentenced to be issued.
