FLOODING DRAIN SUIT AGAINST GRANTSVILLE STILL UNRESOLVED

A civil case filed in 2007 against the Town of Grantsville is still in the local court.

Douglas and Cheryl Davis of Mill Street brought the damage suit against the town, the suit says the couple began complaining in 2003 about a drain causing flooding and damage to their property.

The suit, filed by attorney William Merriman, says as a result of the negligence, the Davis' sustained damage, annoyance, inconvenience and mental suffering.

In January, 2009, Judge David W. Nibert denied the defendant's motion for a summary judgment.

Cheryl Davis is a former town councilwoman.

According to a town council report, another lawsuit for breach of contract by Straight Cut Lawn Care will likely be filed against the town.
