CLAY WOMAN SUES OVER K-MART FALL

A Clay County woman has filed a suit against K-Mart after she was injured when she tripped in the store.

Susan Jackson filed the suit Aug. 1 in Kanawha Circuit Court.

Jackson's husband, Eric Jackson, is also named as a plaintiff in the suit.

According to the suit, Susan Jackson went to the Elkview K-Mart on Aug. 2, 2006.

She says while shopping a dangerous and unsafe condition on the floor caused her to trip and fall.

She says she incurred serious physical and mental injuries, some of which are permanent in nature.

The suit claims Jackson incurred medical bills, physical pain and suffering, permanent disfigurement and scarring, emotional distress and annoyance and inconvenience.

Eric Jackson claims he suffered a loss of consortium from his wife.

They are seeking compensatory and punitive damages.
