MISUSE OF FUNDS CHARGE DROPPED AGAINST SMITH - Trial Scheduled For August

A criminal charge was dropped this week in a case against Christopher Todd Smith of Grantsville.

An indictment count related to Smith's misuse of his elderly grandmother's funds was dismissed.

A suppression hearing on other criminal counts is scheduled for May 16th.

Smith has been charged with the possession of a controlled substance with intent to deliver.

Smith was arrested by the Grantsville Police Department, who say he possessed a considerable amount of marijuana.

Last October a search warrant for Smith's residence was obtained, at which time Chief Stephens and Trooper 1st Class Jeff Hunt "located a gallon-size bag of marijuana in a dresser drawer," according to a police report.

Police say they found 117 grams of marijuana in addition to other drug-related items, including a green Tupperware container with marijuana seeds labeled 9/17/07.

After the marijuana was discovered, Chief Stephens said following the reading of Smith's Miranda Rights, Smith claimed the marijuana was not his, and that someone must have broke into his house and "left that stuff."

Charges have been filed against Smith related to more than one incident involving shooting a pellet-type gun at newspaper carrier Charlie Adams of Grantsville.

A police report says a pellet struck Adams vehicle during one of the incidents.

Gazette carrier Adams told police he was shot at a second time with his son in his vehicle during early morning hours while delivering papers.

Smith was also charged for riding an ATV in the Town of Grantsville on a suspended license.

Smith is scheduled for trial this August.

Also in court this week, Stephen Buvoltz of Arnoldsburg was sentenced to six months in Central Regional Jail on counts of brandishing a weapon, but the court granted a motion for home confinement.
