SMITH WILL STAND TRIAL FOR FAILURE TO REGISTER - Judge Denies Rush Request To Modify Probation

A trial is set for Grantsville resident Bernard Smith on March 11, according to Calhoun Prosecuting Attorney Shelly Demarino.

Smith has been charged with failure to register as a sex offender.

During Monday's circuit court session, with Judge Thomas Evans III, presiding, Grantsville resident Sara Beecher pled guilty to two misdemeanor drug charges. Beecher was represented by attorney Tom Whittier.

Judge Evan's denied a request entered by Jerome Novobilski for Brian Rush to modify the terms of his probation so he could marry his fiancé who is 25-years-old, who has a son 2 1/2 years old.

Rush is under restrictions related to the sexual abuse of a 13-year-old female.

Rush's probation ends later this year.

Prosecutor Shelly Demarino told the court she felt the public interests are best protected by sticking with the original conditions.

The sentencing for Jennifer Jones was delayed and a case against Amber Jo Wilson was continued.
