ASSAULT CASE DISMISSED AGAINST SMITHVILLE TRIO

(12/07/2007)
Ritchie County Prosecutor Steve Jones says sexual abuse charges have been dismissed against a Smithville trio.

Jones says Mary McCullough of Smithville, her husband Daniel and his mother, Sheila Smith, no longer face the charges "because of issues that have developed in a companion case."

The charges are connected to the alleged assault of a four-year-old child.

Prosecutor Jones declined to elaborate, but did say it is linked to another case related to the custody of children.

Court records say McCullough was originally indicted on 21 counts of sexual assault and abuse. Daniel McCullough was named in an 11-count indictment while Smith faced two counts of sexual assault and abuse.

The alleged abuse started in November 2006.
