A news release from the West Virginia State Police, troopers were conducting a traffic safety checkpoint on Route 21 near Chandler Drive when a Chevy S-10 pickup pulled up and one of the passengers appeared to be hiding something.

After the troopers asked the pickup driver, Marlin Koch, 43 of Renick to pull over, they say he initially followed instructions, but then took off.

State Police say he pulled into a private driveway and drove behind a someone's house.

Troopers say that when they got out of their cruisers and headed to the back of the house, the pickup truck pulled out and accelerated in their direction.

State Police say Koch immediately stopped after the shots were fired.

Koch is charged with fleeing while driving under the influence, driving with a suspended license, assault during the commission of a felony, possession of marijuana, and other traffic offenses.

They say Koch was a fugitive from New York for probation violations. Koch's two passengers, Randy Paul of Lewisburg, and Curtis Hinkle of Beckley, were both charged with possession of marijuana.
