DUPONT HAS MORE WOES IN HARRISON COUNTY

DuPont has more woes than the C-8 problem in the Mid-Ohio Valley.

Closing arguments are under way in a class-action lawsuit against DuPont and another company over a 112-acre waste site in Clarksburg.

Ten Harrison County property owners are suing DuPont and New York-based T.L. Diamond and Company over claims the companies dumped arsenic, cadmium and lead on the site of a former zinc-smelting plant in Harrison County.

Over a period of 90 years, the plant produced more than 4 billion pounds of slab zinc and 400 million pounds of zinc dust, materials used in rustproofing products, pigments and battery anodes.

The plaintiffs argue the companies knew the waste was dangerous and acted with negligence.

Attorney Mike Papantonio compared the battle between the residents and the companies to David and Goliath.

DuPont and Diamond both deny any wrongdoing.

This week's arguments mark the end of the first phase of what could be a four-part trial.

The jury must first decide whether DuPont and Diamond caused the contamination.

If they say yes, a second phase will determine whether the plaintiffs deserve medical screenings similar to the tens of thousands who have received the procedure related to the Washington Works plant in Wood County.

A third phase would address property damages, and the fourth punitive damages.
