HARDWAY TO BE ARRAIGNED - Circuit Court Has Several Cases

Billy Ray Hardway, 45, will appear in Calhoun Circuit Court today over an indictment this month, one count of possession with a firearm by a felon.

He is scheduled for arraignment on the charge before Judge David W. Nibert.

Three counts of wanton endangerment with a firearm, related to an alleged incident involving juveniles, were dropped.

DNR officer John Apgar filed the endangerment charges after he investigated an incident in early August, alleging that Hardway had threatened three Daniel's Run juveniles with a gun.

Misdemeanor charges against Hardway for assault on DNR officer John Apgar are still in magistrate court, filed by investigating officer Cpl. Doug Starcher of the WV State Police. Apgar, according to police reports, shot Hardway in the shoulder after he allegedly resisted arrest and threatened to wield a knife against the officer.

Hardway is currently in Central Regional Jail.

Also appearing court today is Greg Springston, who has multiple charges related to the vehicular death of a Spencer man, DUI, and failure to appear. Today's appearance is related to the status of his case.
