GRAND JURY INDICTS HARDWAY FOR POSSESSION OF FIREARM

A Calhoun grand jury has indicted 45-year-old Billy Ray Hardway of Daniels Run on one count of a felon in possession of a firearm.

Hardway had also been charged in magistrate court with three counts of wanton endangerment involving a firearm, but those charges did not appear in yesterday's indictment.

DNR officer John Apgar filed the endangerment charges after he investigated an incident in early August, alleging that Hardway had threatened three Daniel's Run juveniles with a gun.

Hardway is seeking to have his $100,000 cash bond reduced.

Misdemeanor charges against Hardway for assault on DNR officer John Apgar are still pending in magistrate court, filed by investigating officer Cpl. Doug Starcher of the WV State Police.

Apgar, according to police reports, shot Hardway in the shoulder after he allegedly resisted arrest and wielded a knife against the officer.

The grand jury returned five other indictments yesterday, but there was no presentment by the special prosecutor handling the sexual assault case against former Grantsville police chief Ron Gordon.
