HARDWAY WAIVES HEARING ON MULTIPLE CHARGES - Case Bound Over To Grand Jury

A Daniel's Run man who allegedly resisted arrest and was shot by DNR officer John Apgar, waived a preliminary hearing yesterday in Grantsville, his case will be bound over to a grand jury.

Billy Ray Hardway, 45, has been charged with three counts of wanton endangerment involving a firearm and illegally possessing a firearm as a felon. He is currently in Central Regional Jail.

Those charges are related to an incident earlier this month where Hardway allegedly brandished a weapon, threatening to kill three Daniel's Run youths.

Hardway is yet to be charged over the most recent incident, where Apgar and another DNR officer were attempting to serve him warrants.

Hardway was allegedly shot in the shoulder by Apgar.

State Police are investigating the shooting, but have yet to release a statement regarding circumstances surrounding the incident.

Hardway is being held on $100,000 cash bond at Central Regional Jail, he is scheduled to appear before Judge David Nibert this Thursday with a motion to amend his bond.
