CALHOUN MEN SENTENCED BY JUDGE EVANS - Calhoun Circuit Court

Guy Denzil Knicely has appeared before the Calhoun Circuit Court for imposition of sentence, according to court records. The court found the plea agreement did not intrude on the discretion of the court and was approved.

Judge Thomas Evans III found Knicely guilty of fleeing from an officer and guilty of diving while under the influence while license was suspended, second offense.

Knicely was sentenced to Central Regional Jail for a period of 10 days for the driving while license suspended, second offense, which was listed as a misdemeanor.

He was sentenced to Central Regional Jail for "six months for the offense of fleeing from an officer, a misdemeanor, a lesser included offense of fleeing from an officer while DUI, a charge in count one...with credit served for 41 days.."

The court then suspended the defendant's sentence for the offense of fleeing from an officer, a misdemeanor, and gave community service as an alternative sentence. He also received a fine of $50.

Gary Dale Goodrich was ordered to be placed in the West Virginia Penitentiary for an "indeterminate period of not less than one year nor more than three years" for driving under the influence, third offense, a felony. A motion for home confinement was denied "being contrary to public interest and the defendant likely to commit further crime." He was also ordered to pay a $3000 fine.
