CITIZENS CAN FILE SUITS AGAINST STATE LOCALLY - Manchin Contends New Law Not Necessary

Gov. Joe Manchin vetoed a bill that would have allowed lawsuits targeting the state, its agencies and officials to be filed outside of Charleston.

Lara Ramsburg, Communications Director for Governor Joe Manchin, says existing state law already allows for residents to file suits in their home county.

She says the Governor vetoed that legislation because case law already allows for that to happen if someone chooses to do so, meaning a specific law is not necessary.

"It's dealt with in case law," says Ramsburg, "And so it's not necessary to put it into code and there were things in the bill that contradicted some of the case law issues so it was really just an issue of case law and what had already been decided by the State Supreme Court."

Most WV residents are unaware they can file suits locally.
