ELIZABETH MAN PLACED ON PROBATION - Sold Stolen Gun Linked To Double Murder

(02/28/2006)
An Elizabeth man has been placed on probation for stealing and selling a gun used to kill a Wirt County man and his girlfriend.

Daniel Allen Neptune, 21, was sentenced to five years probation by Circuit Judge Robert Waters in the Wirt County Circuit Court, following a plea deal which calls for Neptune to testify against his uncle, Roger Dean Flinn, 43, who has been charged with murder.

He was also ordered to pay costs related to the crime.

Neptune was represented by Grantsville attorney Kevin Postalwait.

Flinn is charged with two counts of first-degree murder in the shooting deaths of Russell Ray Eastham and Sylvia L. Fittro.

Police found Eastham's body in a ditch a few miles from the Roane County line. Following a trail of blood, police discovered Fittro's body near her 10-month-old child, who was uninjured.

Flinn is scheduled to go to trial in June.
