DUMPSTER TRASH CASES BEFORE MAGISTRATE - Charges Against Cunningham Dropped

(03/24/2005)
Seven county residents who were issued criminal complaints, all misdemeanors, for illegally dumping trash in a Grantsville dumpster, went before Magistrate Rick Postalwait yesterday.

The case against Ralph Cunningham was dismissed after CRI sent a letter to Prosecuting Attorney Matt Minney stating the boxes found in their dumpster were placed there by them, not Mr. Cunningham.

Lennette Headley and April Dawn Drake, plead not guilty, having hired an attorney for separate hearings to be scheduled.

Nichole M. Yanero, Shirley VanHoose and John F. Schneider were assessed costs and fees.

The case against Norma J. Freshour is pending.

DNR officer John Apgar, who brought the complaints at the request of the Town of Grantsville, said he spent 96 officer hours investigating the illegal dumping, including "all-night surveillance's, picture taking, and collection of evidence from the dumpster."

Grantsville Mayor Neil Blankenship said the non-paid dumping of trash in Grantsville has become an enormous problem. "It is an expense the town cannot afford," he said. "Some people want a free ride."
