CLAY MAGISTRATE FINDS PROBABLE CAUSE - Jarvis Charged With Malicious Wounding

(01/20/2005)
A Calhoun County man is being bound-over to the Clay County grand jury for assaulting an off-duty Calhoun County deputy sheriff in October.

Clay magistrate Jeff Boggs found probable cause Tuesday against Rodney Jarvis of Chloe, who had been charged with the unlawful malicious wounding of Bandy.

Eight to ten witnesses reportedly testified during the hearing.

Jarvis' case will likely be on a March docket.

State Police said Bandy received multiple injuries during an altercation in front of Froggy's Lounge at Big Otter. He was taken to Charleston Area Medical Center where he was hospitalized for several days.

State Trooper B. G. Wriston said Bandy was trying to get Robert King into the passenger side of a Ford Mustang, when King turned and struck Bandy in the face.

"Rodney Jarvis put the Mustang in reverse, knocking Mr. Bandy to the ground," said the officer, after which he continued to back up running over Bandy's legs.

The officer said Jarvis then drove the vehicle forward and ran over Bandy again.

Jarvis, King and a third man identified as Robert Greathouse then left the scene, said Wriston.

Robert James King has been charged with brandishing.

King is to appear before Clay magistrate Mitchell King today for a pre-trial hearing.

He has requested a jury trial.

In the earlier incident, King was allegedly driving a "big-wheeled" truck when he crashed into a group of people at another bar near the I-79 interchange. Several people witnessed the incident, but a Clay jury found King not guilty of the offense.

A third man, identified as Robert Greathouse, left the scene with Jarvis and King, said Wriston.

Jarvis and King reportedly returned to the scene driving a flatbed truck, with King "hanging out the side window, brandishing and firing a firearm."

State Police took statements from six individuals at the scene, in addition to Bandy.

Bandy has returned to work, assigned as Chief Deputy for Calhoun County.
