HIGHWAY DEPARTMENT BRINGS SUIT AGAINST CALHOUN LOGGING OPERATOR

The West Virginia Division of Highways has filed a suit in Kanawha County against a Calhoun logging operator, claiming the operator did substantial damage to public roads.

The suit seeks compensation from Mark Cain, doing business as Little Kanawha Logging Company for damages done to Calhoun roads 35/12 and County Route 14 and for damages to Roane County roads 39/12 and County Route 14.

The West Virginia Division of Highways claim Little Kanawha Logging's "negligent actions" caused the department an expenditure of $16,315 to repair the damaged roads.

Little Kanawha Logging, represented by attorney Daniel Schuda, has denied responsibility for the allegations.

Court documents say the attorney has asked that the suit be dismissed with prejudice.

An earlier suit against Little Kanawha Logging for damaging the Lemuel's Run Road (Bryner Road) shortly after it was re-surfaced was dropped.
