GILMER PROSECUTOR RECUSES SELF FROM POISON CASE - Woman Charged With Attempted Murder

(04/22/2004)
Gilmer County Prosecuting Attorney Gerald Hough has recused himself from a case where a North Carolina woman has been charged with poisoning her four-year-old granddaughter.

Hough said yesterday he has a conflict of interest, related to doing work for the child's family.

The case will be prosecuted from Webster County.

Authorities have charged Marcia Lemons, 58, with attempted murder. She is being held in Central Regional Jail.

Lemons was arrested Monday while she and the girl were staying at a Best Western motel just outside of town.

The Gilmer County Sheriff's Department said Lemons called 911 and requested a police officer to come to the motel. She allegedly gave a statement to police saying she tried to poison the girl.

The child was treated at WVU Hospital and is now in foster care.

Police have declined to talk about what the woman gave the girl or confirm the other circumstances related to the incident.

The woman had apparently taken the child to the motel since there were not enough beds at a family residence.

Lemon's bond has been set at $250,000.
